All services provided by SMFNEW or the affiliated networks provided by MATLEX are for lawful purposes only, any forums deemed to be unlawful or against any of our terms are subject to be suspended immediately without notice. Transmission, storage or presentation of any information, data or material must be within the United States federal, state or city law. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless SMFNEW from any claims resulting from the use of service which damages the subscriber or any other party. If your forum is suspended or deleted you may still request a backup of your data from SMFNEW administrators, however, SMFNEW are not legally bound to offer you this data if it is deemed illegal.
Your forum must not store, present, transmit or link to any adult material or a third party website with pornographic content. This includes pornographic images of adults and/or minors.
Your forum must not store or present "spam" content by yourselves or other members. Spam includes but is not limited to, advertisements, and/or flaming. It is the responsibility of the forum owner to remove the forum of any and all "spam" and SMFNEW holds the right to suspend the forum is this does not occur.
Your forum must not be on a subject, or hold content which discusses illegal material and/or topics. Topics include but are not limited to terrorism, drugs, firearms, invasion of privacy, impersonation of others, viruses, email spamming, harassment, or any breach of copyright laws within the United States. If this does occur SMFNEW will supply the database with any information on the users to the authorities if deemed necessary.
You may not edit or remove any links, advertisements or any other forced content which has been placed by SMFNEW or Simple Machines Software®. Your forum must also not solely link to another website.
You acknowledge that you are responsible for your forums content and that it can be deleted without notice due to a violation of these terms. You are solely responsible for what your members/guests post upon your forum. If there has been no admin login for 3 months (90 days) SMFNEW reserves the right to remove your forum without notice.
SMFNEW manually monitors posts and topics even if the forums are hidden from the general public, if these posts are deemed inappropriate or deemed to be breaking these terms the message will be removed without notice and possible suspension will occur. SMFNEW has a variety of automatic checks in place to check for spam and illegal content which may result in an automatic suspension from all of SMFNEW.
Data loss can occur, this can be due to a server or networking fault, SMFNEW holds no responsibility for data loss, SMFNEW back up forums, however, it is the forum admins responsibility to store a backup, and without a backup we cannot guarantee a restore. Data loss can also account for an abuse of powers where a member has been given moderator privileges and demoted yourself or deleted topics, SMFNEW will not restore a forum for free if this occurs. Without your own backup a charge of $2.95 will be requested for any forum restore.
The owner of any forum on the SMFNEW network will be governed by the email used on signup, if there is to be a change of ownership you must contact SMFNEW for permission. SMFNEW does not guarantee that a change of ownership will be accepted.
SMFNEW reserves the right to be able to refuse requests for your forum to be deleted. You are able to disable your forum in your Administration panel under the setting named "Enable Board".
SMFNEW provides the option to use your own domain instead of using an SMFNEW subdomain. SMFNEW reserves the right to reject any request for an addon domain if it is deemed inappropriate as a domain name. SMFNEW may remove the domain name after it has been added if the forum has violated these terms or the domain name is being used inappropriately.
SMFNEW gives you the option to import your own SMF forum that is not hosted by SMFNEW or affiliates. You agree that once your forum has been imported to SMFNEW it complies with these terms. SMFNEW has the right to deny your import request.
SMFNEW reserves the right to modify these terms and conditions at any time without prior notice, after a modification to these terms you have seven (7) working days to refuse the new terms and have your data removed from the SMFNEW servers.
If you find any forum which violates any of these terms please contact us as soon as possible with sufficient evidence to disable such forums. SMFNEW will work with any legal organisation to provide information about any user which is deemed to be using SMFNEW for illegal purposes.
